Conclusion The IOF’s indiscriminate targeting of civilians and civilian residential, industrial and commercial units throughout the reporting period indicates that Israel may be committing war crimes and crimes against humanity in the Gaza Strip. In the conduct of hostilities, Israel must comply with the principle of distinction between civilian and military objects, as per Article 48 of the First Additional Protocol to the Geneva Conventions, as well as the prohibition of indiscriminate attacks “which may be expected to cause incidental loss of civilian life, injury to civilians, damage to civilian objects, or a combination thereof, which would be excessive in relation to the concrete and direct military advantage anticipated” as per Article 51(5)(b) of the First Protocol to the Geneva Conventions, also considered as customary law. In particular, the IOF’s unrelenting bombardment of Al-Rimal neighbourhood, and especially of medical structures and installations, has deleteriously impacted the functionality of health services, as well as on the ability of health workers to provide critical health care. In the conduct of hostilities, Israel must support in all its efforts the protection of hospitals, as well as the establishment of ‘hospitals and safety zones and localities,’ to ensure the protection of the civilian population, as per Article 14 of the Fourth Geneva Convention. Al-Haq urges the international community to take immediate and effective measures to bring Israel in compliance with its obligations to spare and protect the Palestinian civilian population, and calls on the Prosecutor of the International Criminal Court to include Israel’s 2021 military offensive on the Gaza Strip into the scope of its investigation for war crimes and crimes against humanity.[1] This report provides a preliminary non exhaustive report of the attacks on the Gaza Strip on Tuesday 18 May 2021.

On Monday, 17 May 2021, the IOF stationed behind the borders, east of Gaza City, bombed a number of factories and warehouses, located in the industrial zone east of the Shejaiya neighbourhood, east of Gaza City, causing the destruction and burning of nine factories. Among the factories that were completely destroyed: Al-Harir Factory for the manufacture of chips, Siksak factory for plastic pipes, Al-Wadi factory for food industries, Maatouq ice cream factory, Clever detergents factory, Abu Iskandar nylon factory, Company PWS Renewable Energy, stores company ‘In your hand Maintenance,’ Rafiq Textiles & Readymade Garments Company.
Furthermore, throughout the reporting period, IOF warplanes continued to bomb dozens of missiles in many areas of the Gaza Strip, targeting agricultural lands and sites of the Palestinian resistance. Several shells landed on a number of houses, forcing the residents of those areas to evacuate and seek shelter. Israeli gunboats stationed at sea also targeted the seashore. On 17 May 2021, at around 12:30 pm, an Israeli strike near the Maldives Rest House on the seashore, west of Gaza City, resulted in the killing of:
Ali Walid Al-Abd Al-Abed Brayes, 30
Ahmed Khalil Hijazi Al-Louh, 23
Muhammad Jamal Ali Abu Saman, 24
Muhammad Hassan Hassan Abu Samaan, 31
On 19 May 2021, at approximately 8:30 am, IOF warplanes targeted the home of Hamas leader Dr. Atallah Abu Al-Subah, in Al-Jeneina neighbourhood, Rafah, resulting in the complete destruction of the two-storey house, and severely and partially damaging a number of neighbouring houses.
Conclusion
The IOF’s indiscriminate targeting of civilians and civilian residential, industrial and commercial units throughout the reporting period indicates that Israel may be committing war crimes and crimes against humanity in the Gaza Strip.
Al-Haq urges the international community to take immediate and effective measures to bring Israel in compliance with its obligations to spare and protect the Palestinian civilian population, and calls on the Prosecutor of the International Criminal Court to include Israel’s 2021 military offensive on the Gaza Strip into the scope of its investigation for war crimes and crimes against humanity.

Ramallah, February 11, 2020—An explosion in the northern Gaza Strip in late January destroyed a residential building, damaged several public buildings, and caused injury to 18 Palestinian children.
The explosion occurred on January 23 around 8:15 a.m. originating on the roof of a three-story residential building in a densely-populated neighborhood in Beit Hanoun, located in the northern Gaza Strip. The building owner’s son, Ahmad Al-Kafarneh, 32, built and maintained a warehouse on the roof used to store munitions and military equipment for the Palestinian armed group, Saraya Al-Quds, the military wing of Islamic Jihad, of which he is a member, according to a source in the North Gaza General Investigation Department.
“Palestinian armed groups must take measures to protect civilians including not storing explosive materials and weapons in densely populated civilian areas,” said Ayed Abu Eqtaish, DCIP’s Accountability Program Director. “The de-facto Hamas-run government must conduct a thorough, independent, and impartial investigation into this incident and all necessary measures must be taken to ensure Palestinian armed groups in the Gaza Strip do not store weapons and munitions in densely populated civilian areas.”
The explosion destroyed the residential building and damaged a nearby hospital, police station, and three United Nations-run schools. At least 26 houses were damaged in the blast, according to information collected by DCIP.
Six of Al-Kafarneh’s children sustained injuries from the blast, with Al-Kafarneh sustaining the most severe injuries, according to information collected by DCIP.
The Al-Kafarneh children were preparing to have breakfast on the ground floor of the building when the explosion occurred. Nahedh, 10, sustained a minor injury to his left leg; Enas, 9, was struck by glass shrapnel in the left leg; Abdulkareem, 7, was struck by glass shrapnel in the head; Habiba, 6, was struck by shrapnel in the head and legs, and three-year-old Ni’ma and one-year-old Hayat sustained bruises. An additional 12 children sustained mild to moderate injuries from the blast, according to information collected by DCIP.
There is no indication that any of the children injured in the blast were involved with the Palestinian armed group Saraya Al-Quds or any other armed group, according to evidence collected by DCIP.
In recent years, DCIP has documented several child fatalities and injuries occurring within the context of activity by or involvement with Palestinian armed groups. Odai Mansour Abu Hassan, 11, was killed on July 15, 2018, when an improvised explosive device accidentally detonated on his roof, according to an investigation by DCIP. Odai’s father was a Palestinian armed group field commander in the military wing of the Fatah movement.
Palestinian children in the Gaza Strip are at risk of violence, including accidental violence, as a result of Palestinian armed group activities. Between January 2011 and September 2020, DCIP documented the deaths of nine children and the injury of two children who were involved with Palestinian armed groups.
Palestinian children in the Gaza Strip are increasingly vulnerable and at risk of death and injury due to repeated Israeli military offensives, attacks, and incursions. Additionally, Israel’s ongoing closure of the Gaza Strip has created an acute, human-made humanitarian crisis and deteriorating economic context within which children are vulnerable to recruitment during active hostilities.
